TERMS and CONDITITIONS
⦁ Use of Our “Library”
EBLG provides a worldwide online ebook Library for children allowing digital media contributors to share their ebooks and moving visual digital media. You do not have to register in order to visit ebooksforlittlegreeks.com. To access our free ebooks you will need to register with ebooksforlittlegreeks.com (“EBLG”) and create a “Membership account”.
⦁ Digital Content Contributors
You, as parent/guardian have given permission to EBLG to publish, online, your child’s artwork (“Digital Content”), name, age of child at the time the artwork was completed, and the country the child resides in, for a length of time as determined by EBLG, on the EBLG website and do hereby irrevocably agree:
⦁ You, as parent/guardian agree that except for your child’s Digital Content, all right, title, and interest in and to the Library and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, Library marks, copyrights, photographs, audio, videos, and music are and will remain the exclusive property of EBLG. Use of the Digital Content or materials in the Library for any purpose is strictly prohibited.
⦁ You, as parent/guardian agree you are not an Employee of EBLG as contribution to EBLG Digital Content does not create an employer-employee relationship between you and EBLG. You are solely responsible for payment of any taxes, social insurances/charges or other fees related to earnings received. You are solely responsible for the development, Digital Content, operation, maintenance of your child’s Digital Content and you will ensure that your child’s Digital Content and End Users’ use of your child’s Digital Content will not violate any of the Policies applicable by law.
⦁ You, as parent/guardian agree that you will not use the EBLG website for any purpose that is unlawful or prohibited by the terms or conditions. EBLG may in its absolute discretion suspend, stop or end your access to the EBLG website.
Your child’s Digital Content will be forwarded to us wherein it will be verified for suitability before it is uploaded onto EBLG Amazon Web Services (“AWS”) storage cloud and thereafter onto the EBLG website. Only EBLG and their employees have access to the data and Digital Content stored. AWS Security will implement reasonable and appropriate measures designed to help secure your child’s Digital Content against accidental or unlawful loss, access or disclosure. You consent to the storage of your child’s Digital Content in, and transfer of your child’s Digital Content into, the AWS region. AWS will not access or use your child’s Digital Content except as necessary to maintain or provide the Service Offerings. AWS will not disclose your child’s Digital Content to any government or third party or move your child’s Digital Content from the AWS region; except in each case as necessary to comply with the law or a binding order of a governmental body. Unless it would violate the law or a binding order of a governmental body, AWS will give notice of any legal requirement or order referred to.
Once we receive your child’s Digital Content, we make commercially reasonable efforts to ensure the security of our systems. We have implemented commercially reasonable technical and organizational measures designed to implement your privacy settings and secure your personal information and your child’s Digital Content from accidental loss and from unauthorized access, use, alteration or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information or your child’s Digital Content for improper purposes. You acknowledge that you provide your personal information and your child’s Digital Content at your own risk.
We will confirm your child’s Digital Content contribution by email to your registered email address. By providing EBLG with your email address you consent to our using the email address to send you library-related notices, including changes to features of the Library, special offers, any notices required by law, for marketing or other business related purposes or through conspicuous posting of such notice on our website, as determined by EBLG in its sole discretion.
Upon the upload of your child’s Digital Content we would ask that you check your child’s Digital Content and contact our Web Support team at firstname.lastname@example.org if there are any discrepancies.
You agree that your child’s Digital Content will be given to EBLG without any financial gain on your part. No charges will be levied and no payments, commission or royalties will be paid by EBLG to you, your child or representatives from the sales of the materials or merchandise. After verification for suitability, it will be uploaded onto the EBLG website for free viewing to all Library and non-Library members alike.
You, as parent/guardian are solely responsible for your interactions with EBLG members. We reserve the right, but have no obligation, to monitor disputes between you and other members.
You, as parent/guardian agree that all aspects of the Library are subject to change or elimination at EBLG sole discretion. EBLG reserves the right to interrupt the Library and/or to permanently or temporarily terminate, suspends, or otherwise refuse to permit your access to the Library with or without prior notice for any reason. You agree that EBLG will not be liable to you for any interruption of the Library.
Upon the Termination Date all your rights under this Agreement are immediately terminated.
The term of this Agreement will commence on the Effective Date and will remain in effect until terminated under this Section in compliance with the notice periods stated.
(a) Termination for Convenience.
(b) Termination for Cause.
By Either Party. Either party may terminate this Agreement for cause if the other party is in material breach of this Agreement and the material breach remains uncured for a period of 30 days from receipt of notice by the other party. No later than the Termination Date your child’s Digital Content will be removed from the Library.
You, as parent/guardian can request that we return all Confidential Information and all materials connected with or related to your child’s Digital Content without retaining any copy thereof.
Any attempt by you to transfer any of the rights, duties or obligations hereunder, except as expressly provided for in this Agreement, is void. EBLG reserves all rights not expressly granted under this Agreement.
While EBLG has taken every reasonable effort to ensure that the information contained within the EBLG website, is correct, you should be aware that changes are periodically made to the information herein and EBLG may make improvements and/or changes to the EBLG website at any time.
EBLG makes no representations about the suitability of the information and services contained on the EBLG website for any purpose. We cannot accept any liability for any reliance placed by you on any statement or representation on the EBLG website, whether made by us or a third party.
Save as aforesaid and to the extent permitted by law, EBLG shall not be liable for any loss of profit, loss of opportunity, loss of business, indirect, incidental, special, or consequential loss arising out of or in any way connected with the use of any information, ebooks, and services on the EBLG website or otherwise arising out of the use of the EBLG website and all terms and conditions with regard to such information, ebooks, and services, whether expressed or implied arising under statute or at common law or otherwise are hereby excluded. Nothing contained herein shall prejudice your statutory rights as a consumer.
⦁ Copyright and use of the ebooksforlittlegreeks website
Without EBLG prior written consent, you will not issue nor authorize the dissemination of any publicity or news story relating to;
a) The Confidential Information.
b) Any agreement with EBLG.
c) Any services by you related to the EBLG materials, Digital Content and/or ebook.
d) Any merchandise (including publications) produced by your child which relates to EBLG materials, Digital Content and/or ebook.
The copyright in the material contained in the EBLG website belongs to EBLG and its individual authors, all rights reserved. Except solely for your own personal and non-commercial use, no part of the EBLG website may be copied, adapted, modified, distributed, transmitted, displayed, performed, reproduced or published without the prior written permission of EBLG or its authors.
The copyright materials contributed by Roxana Christou, all rights reserved, are works of fiction. Names, characters, businesses, places, events, locales, and incidents are either the products of the author’s imagination or used in a fictitious manner. Any resemblance to actual persons, living or dead, or actual events is purely coincidental.
⦁ Additional Representations and Warranties
In connection with your EBLG Library Digital Content, you affirm, represent and warrant, in addition to the other representations and warranties in this Agreement, that:
a) You are at least 18 years of age.
b) Your EBLG child’s Digital Content and EBLG use thereof as contemplated by this Agreement will not infringe any rights of any third party, including but not limited to any intellectual property rights, privacy rights and rights of publicity.
c) EBLG may display your child’s Digital Content granted under this Agreement without liability for payment of any guild fees, residuals, payments, fees, or royalties payable under any collective bargaining agreement or otherwise.
The Library is controlled and operated from its facilities in the Republic of Cyprus. Those who access or use the Library from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable and local laws and regulations, including but not limited to export and import regulations. Unless otherwise explicitly stated, all materials found in the Library are solely directed to individuals, companies, or other entities located in EBLG. You agree that:
a) The Library shall be deemed solely based in the Republic of Cyprus.
b) The Library shall be deemed a passive one that does not give rise to personal jurisdiction over EBLG, either specific or general, in jurisdictions other than the Republic of Cyprus. This Agreement shall be governed by the internal substantive laws of the Republic of Cyprus, without respect to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Any claim or dispute between you and EBLG that arises in whole or in part from the Library shall be decided exclusively by the Larnaca district courts in the first instance.
a) Conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities.
b) Exercise or protect the rights, property, or personal safety of EBLG, our Library members or others.
⦁ Acceptable Use Policy
You may not use the Library for any unlawful purposes or for promotion of illegal activities. You may not post any Digital Content in the Library in violation of any applicable law, including intellectual property laws and right of privacy or publicity laws, or any contractual obligation. International authors agree to comply with all local laws regarding online conduct and acceptable Digital Content.
You may not post Library Digital Content or use the Library to create an impression that you know is incorrect, misleading, or deceptive. This includes submitting false data (images, videos, audio, location, place, text, choice, numbers, time, and tags) or otherwise misrepresenting a data contribution.
You may not post Library Digital Content that is pornographic or sexually explicit, hateful, abusive, threatening, profane, or otherwise objectionable.
You may not impersonate others through the Library or otherwise misrepresent your affiliation with a person or entity in a manner that does or is intended to mislead, confuse, or deceive others.
You may not publish or post other people’s private or personally identifiable information, such as credit card numbers, street address or Social Security/National Identity numbers, without their express authorization and permission.
You may not use the Library for the purpose of spamming anyone.
You may not publish or link to malicious Digital Content intended to damage or disrupt any user’s browser or computer or to compromise a user’s privacy.
You may not do any of the following while using the Library:
a) Access, tamper with, EBLG computer systems, or the technical delivery systems of ‘ebooksforlittlegreeks’ providers.
b) Probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures.
c) Access or search or attempt to access or search the Library by any means (automated or otherwise) other than through the currently available, published interfaces that are provided by EBLG (and only pursuant to those terms and conditions), unless you have been specifically allowed to do so in a separate agreement with EBLG
d) Forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Library to send altered, deceptive or false source-identifying information.
e) Interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Library, or by scripting the creation of Digital Content in such a manner as to interfere with or create an undue burden on the Library.
8. Bugs and Viruses
We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
